Garza faces amended charges

Sergio Gabrial Garza of Glenwood returned to circuit court last Tuesday for an amendment to the charges he faces regarding an alleged hit and run he has been accused of being involved in. The alleged accident resulted in the eventual deaths of two people.
According to documents obtained at the Montgomery County Clerk’s Office, Sergio Gabriel Garza, age  28, was originally arraigned on one count of leaving the scene of an accident involving death or personal injury, a class D felony.
In his most appearance before Circuit Judge Jerry Ryan Garza’s charges were amended to include one count each of battery in the first degree, a class B felony, and negligent homicide, a class B felony.
The charges stem from a two vehicle accident which occurred May 14, 2016. According to reports filed with the Montgomery County Clerk. A 1994 Lexus allegedly driven by Garza struck a 1998 motorcycle driven by Joe Payte and Charlene Payte. Charlene Payte was pronounced dead and Joe Payte was taken to the hospital for treatment of injuries suffered in the accident.
Reports state that witnesses reported seeing Garza allegedly park the Lexus and leave the scene in another vehicle.
Joe Pate later died as a result of his injuries.
Garza was set to appear in court August 2 for a pretrial hearing.
